New Delhi: Nupur Talwar's stay in Dasna jail got extended after the Allahabad High Court on Wednesday deferred the hearing on her bail plea to May 22 in the Aarushi-Hemraj double murder case.
A special CBI court has also fixed May 21 for beginning of arguments on framing of charges against dentist couple Nupur and Rajesh Talwar in the 2008 murder case.
Exactly four years to the day that Aarushi Talwar and her family's domestic help Hemraj were found murdered in her Noida home, a Ghaziabad court began hearing arguments on framing of charges.
The Talwars have filed an application saying the CBI is yet to give them complete probe documents. Verdict on Nupur's plea seeking quashing of criminal proceedings was also reserved by the Supreme Court.
The CBI in its arguments said that the internet router was switched on and off several times during the night of the murder and also argued that an outsider wouldn't use the internet.
The investigative agency said that the post mortem report had revealed that injuries on Aarushi and Hemraj were very similar.
Meanwhile, the Talwars again reiterated that the CBI had not put sufficient evidence on record and the magistrate had not applied her mind correctly to what was there on record.
The dentist couple said that the magistrate has booked both Nupur and Rajesh together when there was no evidence again Nupur. They also said that fresh tests need to be conducted on the pillow cover.
The couple also argued that why would Rajesh mislead the investigators and that is it a grieving man's responsibility to give clues to police.
No identifiable motive and touch DNA hasn't been used to lift fingerprints from the whiskey bottle.
The Talwars had asked for a month to study the documents but the sessions court rejected their plea.
Additional District Judge S Lal fixed the date for beginning of the argument on framing of charges in the 2008 murder case, rejecting Talwars' plea for a month to study the prosecution documents before beginning of the arguments.
Special Judge Lal rejected Talwars' plea saying the Supreme Court has ordered expeditious trial.
The court also asked the CBI to provide all documents related to the case to Talwars by tomorrow evening as the defence counsel claimed that the agency was not providing them the requisite documents.
While Rajesh Talwar is out on bail, Nupur was taken into custody on April 30 by a Ghaziabad court, before which she had surrendered on a direction by the Supreme Court, given to her after her repeated failure to appear before the court to face trial in the twin murder case.
14-year-old Aarushi was found dead with her throat slit at her Noida residence on May 16, 2008. The body of Hemraj was recovered from the terrace a day later.
