CHENNAI: A division bench of the Madras High Court has upheld the orders of a single judge directing the government to reinstate a person, who had been given appointment 12 years ago on compassionate grounds.According to advocate M Ravi, his client S Raghunathan was given compassionate appointment as junior assistant in January, 1996, following the death of his father, who died in harness while working as tahsildar of Salem District Revenue unit in May, 1988. However, in November, 2007, after coming to know that his brother was working in a private firm at the time of the father’s death,he removed Raghunathan from service.Raghunathan filed a writ petition and a single judge on February 26, 2010, ordered his reinstatement. Aggrieved, the department moved the High Court with the present writ appeal to set aside the order of the single judge.Dismissing the appeal, a divison bench comprising Justices Elipe Dharma Rao and R Subbiah observed that the single judge was right in quashing the termination order, both on the ground of inordinate delay of 12 years and Raghunathan’s brother was not a dependent to support his family since before the death of his father he had set up his own family. ‘’Hence, we see no reason to interfere with the orders passed by the single judge,’’ the bench said and dismissed the appeal.
