In a shocking incident at Delhi airport, a passenger on an IndiGo flight, Sahil Katariya, was arrested for assaulting Captain Anup Kumar. The altercation occurred during an announcement about a delay in takeoff bound for Goa, as depicted in a video circulating on social media.
Advocate and Supreme Court of India Panellist, Alexshendra Venus Baksh, emphasized that the law does not grant Katariya any right to assault Captain Kumar, who was communicating a further 10-hour delay for Indigo flight 6E 2175. According to Baksh, if the passenger felt unwell, a lawful request to disembark could have been made. The law also empowers aggrieved passengers to sue the airline for reimbursement or compensation due to significant delays.
Dr. Rennie Joyy, Advocate and founding partner, Judex and Whyte Attorneys, shed light on the legal repercussions of such an assault. He highlighted that attacking a pilot in response to a weather-induced flight delay constitutes a grave offense under Section 353 of the Indian Penal Code (IPC), addressing assault on public servants. Section 332, which deals with causing intentional harm to obstruct a public servant from their duties, further aggravates the offense.
These legal provisions are meticulously designed to safeguard public servants, ensuring they can fulfill their responsibilities without hindrance.
