New Delhi: The Delhi High Court on Tuesday observed that lodging a criminal case against the husband and his family members by a woman did not attribute to the act of cruelty and declined to give a divorce ruling to a man.
Justice S Murlidhar upheld the trial court order dismissing grant of dissolution of marriage.
Murlidhar imposed Rs 10,000 on Sheo Nath Singh and asked him to pay the amount to his wife Sujata within four weeks.
“The institution of a criminal case by Sujata cannot be inferred (to mean) that she had lodged this case with a sole purpose of meting out cruel treatment to her spouse,” news agency PTI quoted Murlidhar as saying.
“The appellant cannot take advantage of a situation as he was the one who had stayed away from his wife and had made no effort to take her back,” he added.
Singh, a Central government employee gave eight examples to support his allegation of cruelty and sought divorce from his wife, a nursing officer in an army hospital.
Singh was living at his official residence of his wife after they got married in 1995.
A year after their marriage, Singh started staying separately from her and sought divorce.
