HYDERABAD: Justice Raja Elango of the AP High Court on Monday heard inconclusively arguments questioning the order of the Special Court for Economic Offences remanding Gali Janardhan Reddy and Srinivas Reddy to custody at the instance of the CBI.
The matter will be heard on September 26 by the judge. While the counsel for Srinivas Reddy said that what the 'opposition failed in Karnataka, they managed to get done in this state and the same was obviously motivated', senior counsel Uday Lalit, appearing for Gali, said the action was motivated by legal malice. The two petitioners questioned the order of the Special Court for CBI cases which on September 13 remanded the petitioners to CBI custody.In his detailed presentation spanning approximately three hours, Uday Lalit said the prosecution was obliged to produce the remand diary alongside the person arrested and failure to do so vitiated the entire process, including the order of remand.

This did not allow the court to consider the reasons for remand and made the order a mechanical one, he said.

"Fix the man first," seems to be the whole approach, he complained and added there were no allegations against the petitioners and the principle of vicarious liability could not be invoked in criminal law.
