BANGALORE: Granting two weeks time to the state government and former Chief Minister B S Yeddyurappa to file their objections, Karnataka High Court today adjourned to December one a PIL challenging the denotification of one-acre land in Nandini Layout.A Division Bench, headed by acting Chief Justice Vikramajit Sen, adjourned the plea filed by Congress MLA N L Narendra Babu.Earlier a Division Bench headed by former Chief Justice J S Khehar, while hearing the PIL, had ordered issue of notices to then Chief Minister B S Yeddyurappa, the state government and, the Bangalore Development Authority (BDA).The MLA had alleged in his petition that Yeddyurappa had, "without applying his mind", on October 19, 2009 denotified one acre of land.The land was denotified, saying that a school building was being built on it.He had sought quashing of the denotification so that the land could be returned to the BDA or BBMP (city corporation) to convert it into a playground or park.The petitioner's counsel had submitted that the original owners of the property were no more. The land had been acquired by the BDA for formation of Nandini Layout in 1979. The BDA had demolished the school building in 2006.When the court sought to know as to what was happening regarding the denotifications by the government, counsel on directions from the High Court on December 3, 2010 filed additional documents on the demolition of the school building.Photographs were also submitted to show that an illegal board had been erected on the plot and it read 'Benaka Vidya Samsthe' (Benaka Educational Institution).The petitioner then requested for a directive against any structure coming up on the plot and the court had ordered that status quo be maintained.
