Mumbai: The Directorate of Revenue Intelligence (DRI) has filed a petition before the Bombay High court challenging the bail given to millionaire Pune businessman Avinash Bhosale.
The DRI arrested Bhosale, a powerful builder and hotelier, at the Mumbai airport on Sunday night after he was found with goods worth Rs 47 lakh. The same night a magistrate granted him bail for Rs 50,000 and asked him to pay Customs duty of Rs 15 lakh. The DRI says the bail is arbitrary.
"Our main argument would be - why was the bail granted without hearing DRI," said an officer adding that the delay in filing the appeal was due to the lengthy procedure.
The defence had moved the bail application at the magistrate's residence in a north-east suburb on Sunday evening and claimed that they had tried to serve a notice of the same to the DRI.
"We arrested him at 7:30 PM on Sunday and all the officers went home after that. You cannot say that the notice is served till they have an acknowledgement from our side," the DRI official said today.
Bhosale, who is said to be close to several prominent politicians in the state, was arrested for allegedly possessing four diamond-studded watches, one mobile phone and several traveller's cheques - all of which were undeclared.
