MADURAI: Refusing to interfere in an investigation being carried out by the police, the HC Bench, while hearing a petition filed by the wife of a suspect in the pipe bomb case, held that the investigation is a prerogative of cops and the court cannot direct how it should be conducted. However, it insisted that cops should maintain records to prove that a person was summoned in connection with a particular case Originally, Safurnissa, wife of A Syed Sulaiman Sait, a suspect in the pipe bomb case, moved the court alleging that the SIT directed her and her husband to appear at various places without issuing proper summons. Subsequently, the inspector of the SIT filed a counter contending that Sait was summoned as he obtained SIM cards in different names and made frequent calls before the said incident. There was no motive to treat him in a cruel manner, he said. When the matter was posted before Justice K K Sasidharan, he recalled the provisions of Statute book to which says, no police shall order a person to appear at the police station sans proper summons. Therefore, he advised cops to maintain proper records.
