Upholding the death penalty awarded to 26/11 convict Ajmal Kasab, the Supreme Court said it had no other option.

New Delhi: Upholding the death sentence awarded to 26/11 convict Ajmal Kasab, the lone surviving terrorist involved in the gruesome attack on India's financial capital Mumbai, the Supreme Court on Wednesday said that it was left with no other option.

"Kasab waged war against India. It is the primary and the foremost offence committed by Kasab," the SC ruling said.

The apex court dismissed Kasab's plea that he was not given a fair trial in the case. Rejecting Kasab's plea of not getting a free and fair trial, the court ruling said, "Not providing counsel to Kasab by the government at pre-trial stage does not vitiate his trial in the case."

The court also said that the confessional statement of Kasab was very much voluntary.

The apex court further upheld the acquittal of two Indian men in the case - Fahim Ansari and Sabauddin Shaikh. They were accused of providing logistical support to Kasab.
