The details emerging from the observations of the court suggest that the e-mail exchanges rule out the possibility of the act being consensual.

Panaji: The Goa sessions court while rejecting Tehelka founder editor Tarun Tejpal's bail plea in the sexual assault case against him earlier this week observed that the CCTV footage of the lift does not falsify the victim's version.

The details emerging from the 21-page observations of the court suggest that the e-mail exchanges in the case rule out the possibility of the act being consensual. The observations also hold importance as all through the arguments, Tejpal's lawyers have been saying that he will be exonerated if the CCTV footage is examined.

The court also observed that bail should be denied as Tejpal could influence the witnesses.

Tejpal has been accused of allegedly sexually assaulting a junior colleague in a Goa resort, during ThinkFest, a high-profile conference organised by Tejpal and his team at a Goa resort. He is currently lodged at the Sada sub-jail in the port town of Vasco, 35 km from here, as prisoner number 624.

Goa police is expected to sum up their investigations and file a charge sheet by the end of January. "The investigations in the case are almost in the final stage. We are waiting for the forensic report of the gadgets seized from Tejpal. The charge sheet would be filed by this month end," the senior crime branch official said.

The crime branch during its investigation had seized gadgets like mobile, laptop of Tejpal which were used to communicate, after the alleged offence took place.
