HYDERABAD: The High Court has set aside the government’s order of resumption of a three-acre land, which was assigned to an exserviceman, at Angallu village in Kurabalakota mandal in Chittoor district. It suggested to the government to pass appropriate orders in accordance with law after giving an opportunity to the petitioners, who had purchased the land in question from the ex-serviceman, to be heard. Justice G Rohini disposed of the writ petition which sought an order holding that the action of the Chittoor district collector, Madanapalle RDO and Kurabalakota MRO to dispossess the petitioners from the land in question was without due process of law and in violation of fundamental principles of natural justice. She said the impugned order of resumption was liable to be set aside on the ground that no opportunity of being heard was given to the petitioners before passing the resumption order. The petitioners claim title and possession of the land in 2004.
