KOCHI: The Kerala High Court has admitted a petition seeking a directive to the State government to not bring CBCE/ICSE schools under the newly-issued criteria for setting up schools.  Most CBSE/ICSE schools were established under the criteria issued in 1988.The court sought the stand of the government in the matter and adjourned the hearing to October 19. It asked how the newly-issued criteria, which do not have retrospective effective, would be applicable to these schools. The petition was filed by the management of Santhinikethan Public School, Kodungalloor. The petitioner submitted that the Kerala High Court, on two occasions, had held that NOC should be issued to those schools which had been functioning as per the criteria set in 1988 and the guidelines of the CBSE. The appeal filed by the State government against the High Court order had been dismissed by the Supreme Court. Therefore, the new criteria should not be made applicable to the schools already functioning, the petitioner submitted.
