Haji Ali trust cannot ban entry of women, Maharashtra tells Bombay HC
The Maharashtra government said offering prayers should be open to both men and women, asserting that the ban by the Haji Ali trust cannot override the right to equality.

Mumbai: The Maharashtra government on Tuesday told the Bombay High Court that the Haji Ali Dargah trust in Mumbai cannot ban the entry of women from the shrine's inner sanctum.

The Maharashtra government said offering prayers should be open to both men and women, asserting that the ban by the Haji Ali trust cannot override the right to equality.

The Haji Ali trust counsel, however, argued that the inner sanctum was crowded and unsafe for women.

There has been massive outrage over the ban, with petitioners moving the high court to overturn it.

This comes almost a week after the Bombay High Court sought the Maharashtra government's opinion on a public interest litigation challenging the decision of Haji Ali Trust to ban the entry of women in the sanctum sanctorum of the historic Durgah.

A bench headed by Justice VM Kanade had asked Advocate General Srihari Aney to submit arguments on behalf of the state on February 9 stating whether women should be allowed into the sanctum sanctorum of the shrine.
