BANGALORE: In a case of custody battle between a couple, a mother's effort to the get the custody of her four-year-old son failed, after the boy refused to go with her, on Thursday.The High Court Judges, were shocked to see that the four-year-old boy was not wiling to go with his mother.Rajesh (name changed) was working as a doctor in Libya while his family lived in Delhi. He met Geetha, also a doctor, who worked in the same hospital in Libya. Rajesh had a daughter from his first marriage and Geetha too was divorced and had a daughter. Rajesh and Geetha were in a relationship and later Geeta became pregnant. They married after Geetha reportedly pressurised Rajesh. A year after their son was born, Geetha is said to have come back to Bangalore, leaving her son in Libya. Later, she moved to England to pursue higher studies.However, later she had approached the High Court to get the custody of her son.The petitioner Geetha, in her submission, stated that she is his mother and according to the law, the son should to given to the mother.A division bench comprising Justice N Ananda and Justice Vegi Suri Appa Rao, bench directed the mother to call her son but her son was not willing to go to his mother. The bench said, "It is first time that we are seeing a 4-year-old child refusing to go with his mother."Further, the bench referred the dispute of the couple to a family court.
