The Kerala High Court on Monday granted anticipatory bail to R S Sanalkumar, a BSNL employee accused of leaking mobile phone call details of a member of the Special Investigation Team probing the T P Chandrasekharan murder case.
Justice S S Satheesachandran said that if the petitioner is arrested, the investigating officer shall release him on bail on furnishing a personal bond of `25,00 along with two sureties for the like amount.
The court directed the petitioner to cooperate with the investigation in order to facilitate its smooth completion. The court observed that no data has been segregated into the protected category by the BSNL under Section 70 of the IT Act and a government notification published thereof.
The observations were made by the court only for the purpose of examining the application for pre-arrest bail and it is a tentative opinion for the purpose alone.
If any notification has been published in the official gazette showing that the computer data of the BSNL is a protected system and there has been an intrusion thereto by an unauthorised person, even if he has been authorised to access it for some other purpose, it can be the basis for prosecuting the offender, the court held.
