CHENNAI: The Madras High Court on Wednesday refused to de-seal the shops in T Nagar area.Instead, the first bench comprising Chief Justice MY Eqbal and Justice TS Sivagnanam directed the traders to approach the monitoring committee, appointed by it earlier in August, 2006, for redress of their grievances.Passing further interim orders on the batch of writ petitions from Citizen, Consumer and Civil Action Group, represented by its trustee Tara Murali of Adyar and others and a batch of miscellaneous petitions from the traders, the bench said that all building/shop owners, whose premises had been locked and sealed by the monitoring committee, should submit requisite details before the committee with their request for de-sealing their premises. The commitee should examine such details on merits and in accordance with law as to whether construction of their building pre-mises was legal and according to the sanctioned plan so that those premises might be de-sealed till the disposal of the cases, which had been fixed for disposal, as agreed, during the fourth week of January, 2012.The committee should pass individual orders on such requests for de-sealing as expeditiously as possible, the bench said. The traders prayed to the HC to permit them to re-open their shops at least till the end of the ensuing Chris-tmas and Pongal festivals. They contended that neither the High Court nor the mon-itoring committee had afforded any opportunity of hearing them. The bench noted the various claims of traders. Some stated that they were in possession of necessary building plans others claimed their regularisation applications were earlier proceeded by the CMDA, others stated they were in possession of certain approvals and claimed to have had satisfied with the fire safety norms apart from complying with other statutory/planning requirements.
