CHENNAI: The Madras High Court has deplored the attitude of advocates writing letters to the Chief Justice of the HC and other top police and government officials to protect lawyers involved in murder cases.“Of late, whenever any member of the Bar was involved in a criminal case, there is an attempt to send petitions to all kinds of authorities, including the CJ. On that basis, petitions are filed either to quash the proceedings pending before the trial court or to derail the investigation by asking for a different investigation. There is no special immunity granted only because the person is holding a law degree or he is practising before a particular court,’’ Justice K Chandru observed while allowing a writ petiton from K Senguttuvan of Keelathirupalakudi in Tiruvarur district, on March 27.The petition sought to quash the order dated March 12, 2008 of the Home Secretary and another order dated March 26, 2008 of the DGP directing the investigating officer to withdraw the chargesheet filed against four accused. According to the petitioner, his brother Tamilselvan was done to death by four identified persons, including advocate Elangovan, the second accused, on December 25, 2005.Allowing it, Justice Chandru observed that it was yet another instance when the organised Bar tried to prevent one of their wayward members from facing prosecution. The judge set aside the orders of the Home Secretary and the DGP and directed the JM-II in Mannargudi to proceed with the case in accordance with law.
