In an affidavit filed in the Supreme Court, the government has stated that it does not support commercial surrogacy.

The Union government is set to make commercial surrogacy illegal. In an affidavit filed in the Supreme Court, the government has stated that it does not support commercial surrogacy.

According to the affidavit, only altruistic surrogacy will be permitted in cases of infertile married Indian couple. The permission will be granted after asserting the needs of the couple. An authority will be set up to see if the requests are genuine.

The government has also decided to prohibit and punish commercial surrogacy services.

With this, no foreigners can avail surrogacy in India and their would be no import of embryo for surrogacy purpose.

The affidavit further states that couples who fail to take custody of of child born with disabilities of any nature through surrogacy will be penalised.
